Terms of use
Upwell is not medical advice. It is a general wellness diary, not a medical device. It does not diagnose, treat, cure or prevent any disease.
Trends are associations, never causes. When two things in your records move together, that does not mean one caused the other.
1. These terms
These terms are an agreement between you and [CONTROLLER NAME] (“we”) about the Upwell app and the upwell.page website. By using Upwell you accept them. How we handle personal data is in the privacy policy.
2. Not medical advice
Upwell helps you keep a record of what you eat, weigh, train and sleep, and shows it back to you. Its targets and estimates are arithmetic over what you logged and general formulas; they can be wrong for you. Talk to a doctor or a dietitian before you change how you eat or train, especially if you are pregnant or breastfeeding, have or have had an eating disorder, or have a medical condition. In an emergency, call your local emergency number.
3. Associations, not causes
When Upwell shows that two things in your records moved together — say, a day with more salt and a higher weight the next morning — that is an association in your own data. It is not proof that one caused the other, and it is not a diagnosis. General facts the app shows next to your data come with their source.
4. Who can use Upwell
You must be at least 16 years old. Upwell plans a calorie deficit only for people aged 18 and over.
5. Private testing
- Upwell is in private testing. Features can change, break or disappear, and data can be lost: keep an export (You › Data & privacy › Export my data).
- Upwell is free while it is in testing.
- Accounts are by invite only. An invite code is personal: do not publish, sell or share it.
6. Your account
An account is optional; the app works without one. If you create one, use your own email address, keep your password secret and use the account for one person only. You are responsible for what happens under your account; if you think someone else has used it, write to support@upwell.page straight away.
7. Your data
What you record in Upwell stays yours. You allow us to store, copy and show it only as far as needed to run the features you use — for example to sync it between your phones, or to show a friend what you chose to share. You can export or delete it at any time.
8. Sharing with friends
You decide what each friend can see, and you can stop sharing at any time. Treat what friends share with you with respect: do not copy it, publish it or use it against them.
9. Acceptable use
Do not:
- break the law with Upwell, or use it to harass or harm anyone;
- try to get into other people’s accounts or data;
- probe, scan, overload or attack our servers, or get around their limits;
- scrape or bulk-download data, or create accounts with bots;
- reverse-engineer the app or the service, except as far as the law allows;
- upload malicious code, or resell or rent out Upwell.
10. Food and menu data
Food data comes from Open Food Facts contributors, from the values restaurants and cafés publish, from USDA FoodData Central, and from our own estimates, which the app marks as such. It can be incomplete or wrong: check the packaging. Names and trademarks belong to their owners; Upwell is not affiliated with them. Sources and licences are on the licences page.
11. Availability and changes
We try to keep Upwell running, but we do not promise that it will always be available or free of errors. We may change or remove features, and we may stop the service; if we do, we will tell you in advance where we can and give you time to export your data. The app keeps working on your phone without our server.
12. Ending
You can stop using Upwell at any time and delete your account (how). We may suspend or close an account that breaks these terms or puts others at risk, and we will tell you why unless the law forbids it.
13. Liability
Upwell is provided free of charge and as it is. As far as the law allows, we are not liable for indirect losses, or for decisions you make based on what the app shows. Nothing in these terms limits liability that cannot be limited by law — for example for intent, gross negligence, or harm to life, body or health — or takes away your rights as a consumer.
14. App stores
If you got Upwell from the App Store or Google Play, their terms apply as well. Apple and Google are not parties to these terms and are not responsible for Upwell or its support.
15. Changes to these terms
If we change these terms, we will tell you in the app or on this page before the change applies. If you do not agree, you can stop using Upwell and delete your account.
16. Law and disputes
These terms are governed by [GOVERNING LAW]. If you use Upwell as a consumer, you keep the protection of the mandatory laws of the country where you live. Disputes go to [COURTS]; as a consumer, you can also go to the courts where you live.
